FERC GRANTS NEXUS IN-SERVICE REQUEST

On October 10, 2018, the Federal Regulatory Energy Commission granted the project’s September 17 request to place NEXUS facilities into commercial service. These facilities include 256 miles of 36-inch greenfield pipe and associated compression.

NEXUS Gas Transmission Project Receives FERC In-Service

CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY:

On August 25, 2017, the Federal Energy Regulatory Commission issued a Certificate of Public Convenience and Necessity to construct and operate the NEXUS interstate natural gas pipeline project. This approval authorizes NEXUS, subject to certain conditions, to proceed with final preparations to commence construction activities and to place the project in service in 2018.

NEXUS Gas Transmission Project Receives FERC Certificate

FERC Final Environmental Impact Statement (FEIS)

On November 30th, FERC issued a Final Environmental Impact Statement (“FEIS”) for the project.

The FEIS is FERC Environmental Staff’s evaluation of all environmental impacts of the project’s construction and operation. The FEIS was prepared by FERC staff and its independent expert consultants, taking into consideration the information NEXUS has provided in its Certificate Application and supplemental filings, as well as input from landowners, communities, key stakeholders and environmental permitting agencies.

The FEIS notes that while construction will temporarily affect the environment, the environmental impacts would be less than significant in light of the project’s proposed mitigation and other mitigation measures recommended by FERC Environmental Staff.

On September 13, 2016 NEXUS submitted a supplemental filing to address certain points raised during the public comment period on the DEIS to provide additional information or perspective to assist in FERC’s National Environmental Policy Act Review Process.

NEXUS Response to DEIS Comments

On September 9, 2016, NEXUS entered into a Precedent Agreement with Columbia Gas of Ohio, Inc. for firm transportation service to be provided to Columbia Gas of Ohio, Inc. on the NEXUS Project. On September 14, 2016, NEXUS submitted the executed Precedent Agreement to FERC as a supplement to the NEXUS Certificate Application

On July 8, 2016 the Federal Energy Regulatory Commission issued a Draft Environmental Impact Statement (DEIS) as a part of its formal environmental review of the NEXUS Gas Transmission Project.

In conjunction with the issuance of the DEIS, FERC also announced it plans to hold six public comment meetings along the route in order to receive comments on the Draft Environmental Impact Statement

FERC Formal Application

On March 3, 2016, the Federal Energy Regulatory Commission issued an environmental information request to the NEXUS Gas Transmission Project as a part of their formal environmental review of the project.

In compliance with the request, NEXUS issued responses to FERC on March 18, 2016.

Responses to the March 3, 2016 FERC Environmental Data Request

On November 20, 2015, NEXUS Gas Transmission (NEXUS) submitted an Application for a Certificate of Public Convenience and Necessity to the Federal Energy Regulatory Commission (FERC) and was assigned docket number CP16-22-000. 

The FERC application initiates the agency’s formal environmental review of the Project as the lead federal agency charged with coordinating National Environmental Policy Act (NEPA) compliance in reviewing pipeline certificate applications. During this period, FERC will evaluate all potential environmental impacts, as well as the company’s plans to address and minimize these impacts.

Through the formal review, FERC will determine if NEXUS will be issued a certificate of public convenience and necessity.

Ferc Pre-File Process

On January 9, 2015, the Director of the Office of Energy Projects at the Federal Energy Regulatory Commission (FERC) issued a letter approving the request to use the pre-filing review process for the NEXUS Project. The proposed project has been assigned docket number PF15-10-000. The docket can be accessed through the FERC website, www.ferc.gov, using the “eLibrary” link and entering the project’s docket number.

The FERC Pre-file process will facilitate early public consultation and involvement in evaluating the proposed NEXUS project facilities prior to submitting a formal application to FERC during the 4th quarter of 2015. The FERC Pre-filing process provides landowners, government agencies and other interested stakeholders an early opportunity to review project information and to identify issues or concerns before a formal Certificate Application is submitted to the FERC or other permit applications are made.

Scoping Process

As part of the Pre-file process, FERC is conducting a comprehensive review of environmental impacts that could result from the construction and operation of the proposed facilities in accordance with the National Environmental Policy Act. As part of its review, FERC issued a Notice of Intent to prepare an Environmental Impact Statement and initiate a public scoping period.

During the scoping period, FERC is encouraging the public and agencies to provide comments on potential environmental issues by May 22, 2015. Comments may be submitted verbally or in writing at the public Scoping Meetings; electronically on FERC’s website (www.ferc.gov) using the eComment or the feature under the link to Documents and Filings; or by mail to this address:

Resource Reports

Draft environmental reports are submitted early during the Pre-filing process to give stakeholders, agencies and the FERC an opportunity to review the information and provide comments prior to our formal application submittal in 4th quarter of 2015. This is a normal part of the FERC pre-filing process, designed to ensure that the formal application for the proposed project is thorough and complete. The FERC and other stakeholders will have multiple opportunities to provide comments regarding the proposed project and environmental reports that will be evaluated and addressed in the final environmental reports that will be included in the formal FERC Application submittal late in 2015
